EKHO — Terms of Use

Last updated: March 2026

These Terms of Use ("Terms") govern your access to and use of the EKHO mobile application and related services, including the EKHO website at ekhoapp.com (together, the "Service").

Operator. The Service is operated by EKHO, Sociedade Unipessoal, Lda, a company registered in Portugal (NIF: 519205073) ("EKHO", "we", "us", "our").

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Purpose and scope

EKHO is a shared camera for live events. It helps groups of friends create collaborative photo and video albums at events, discover live events and purchase tickets, and contribute to official event albums and mosaics. EKHO promotes respect for:

2) Eligibility and account types

Age. You must be at least 13 years old (or any higher age required by your jurisdiction) to use the Service. By registering, you confirm you meet this requirement.

Accurate information. You must provide accurate, current, and complete information during registration and keep it updated.

One account. You may maintain only one account per person or entity.

Account security. You are responsible for keeping your login credentials secure. Notify us immediately at support@ekhoapp.com if you suspect unauthorised access.

Personal accounts. Personal accounts are for individual, non-commercial use of the Service's core features (shared cameras, albums, event discovery, and ticket purchasing).

Artist and promoter accounts. Artist and promoter accounts enable commercial use of the Service, including creating and managing events, selling tickets through the Service, and accessing event analytics. By creating an artist or promoter account, you confirm that you have the authority to act on behalf of the relevant artist, venue, or promoter entity, and you agree to any additional terms applicable to commercial use of the Service.

3) Licence to use the Service

Subject to these Terms, EKHO grants you a limited, non-exclusive, revocable, non-transferable licence to access and use the Service. For personal accounts, this licence is limited to personal, non-commercial purposes. For artist and promoter accounts, this licence extends to the commercial activities described in these Terms (event creation, ticket sales, and event management).

This licence does not include any right to sublicense, sell, resell, reproduce, duplicate, copy, modify, distribute or create derivative works based on any part of the Service, except as expressly permitted for artist and promoter accounts.

4) User content

Your responsibility. You are solely responsible for any content (photos, videos, BOOTH sequences, text, etc.) you upload, share, or otherwise make available ("User Content"). Content you create but do not share remains on your device.

Licence to EKHO. By posting User Content, you grant EKHO a worldwide, non-exclusive, royalty-free licence to use, host, store, reproduce, modify, create derivative works from, communicate, publish, publicly perform, publicly display and distribute such content for the purposes of operating, improving, and promoting the Service. This licence continues until you delete your content or your account, except that copies shared with others or used in event mosaic features may persist.

Representations. You represent that you have the necessary rights and permissions (including from any individuals depicted and relevant rights-holders) to post User Content and grant the above licence without infringing any third-party rights.

5) Code of conduct

You agree not to:

6) Event rules

Many live events prohibit or restrict recording. You are solely responsible for complying with all venue, promoter, artist, and event rules regarding photography, video recording, and related activities. EKHO does not endorse or encourage violating those rules. If you record or share content, you do so at your own risk and must accept any legal consequences.

7) Concert mode and location features

EKHO may offer optional location-based features (e.g., "Concert Mode") that use your device's location data to connect you with events and other users nearby. By enabling location services, you consent to EKHO processing your precise location data as described in the Privacy Policy. You may revoke location access at any time through your device settings, but this may limit certain features.

8) Mosaics and shared features

EKHO may compile User Content into collaborative displays (e.g., event mosaic videos/albums). By uploading content, you agree that it may appear alongside content from other users. EKHO may showcase such mosaics for promotional purposes. If you want your content removed from a mosaic, contact support@ekhoapp.com; however, removal may not be technically feasible in all cases (e.g., after distribution) and is not guaranteed.

9) Intellectual-property and third-party rights

EKHO IP. All intellectual-property rights in the Service (excluding User Content) belong to EKHO or its licensors. You may not use EKHO trademarks without prior written consent.

Third-party content. Music, performances, and other content appearing in User Content may be protected by copyright. EKHO is not responsible for clearing such rights. If you receive a claim, you bear the risk and cost of resolving it.

DMCA / takedown. EKHO respects IP rights and responds to valid removal requests. To report infringement, email complaints@ekhoapp.com with all required details (identify the work, the allegedly infringing material, your contact information, a statement of good-faith belief, and a signature under penalty of perjury).

Repeat infringer policy. EKHO will, in appropriate circumstances, terminate the accounts of users who are repeat infringers of intellectual-property rights.

10) Reporting and enforcement

EKHO may (but is not obligated to) review User Content. We may remove or restrict any content or account that violates these Terms, the law, or our policies, at our sole discretion. You can report content or conduct via in-app tools or by emailing complaints@ekhoapp.com.

Appeals. If your content is removed or your account restricted, you may appeal by contacting complaints@ekhoapp.com. We will review appeals in good faith.

11) Privacy

Please review our Privacy Policy for details on how we collect, use, and disclose personal data. By using the Service, you also agree to the terms of the Privacy Policy.

12) Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, EKHO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EKHO AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT WILL EKHO'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF €100 OR THE AMOUNT YOU HAVE PAID (IF ANY) TO EKHO IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14) Indemnification

You agree to indemnify, defend, and hold harmless EKHO and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or any third-party rights.

15) Third-party services and links

The Service may contain links to third-party websites or integrate with third-party platforms (e.g., music streaming services). EKHO does not control and is not responsible for those services or their content. Use of third-party services is at your own risk and subject to their terms.

16) Termination

You may delete your account at any time through the app settings or by contacting support@ekhoapp.com.

EKHO may suspend or terminate your access at any time, for any reason (including violation of these Terms), with or without notice.

Upon termination, your licence to use the Service ends immediately. Provisions that by their nature should survive (e.g., IP rights, limitations of liability, indemnification) will remain in effect.

17) Governing law and disputes

Governing law. These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles.

Jurisdiction. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Lisbon, Portugal, except where mandatory consumer-protection rules in your jurisdiction require otherwise.

Informal resolution. Before filing any claim, you agree to contact EKHO at complaints@ekhoapp.com and attempt to resolve the dispute informally for at least 30 days.

Consumer ADR (Portugal). If you are a consumer resident in Portugal, you may use the Portuguese consumer Alternative Dispute Resolution system ("RAL") for disputes arising from consumer service contracts. Information about the competent RAL entity(ies) is available on the Consumer Portal (consumidor.gov.pt).

18) General provisions

Entire agreement. These Terms (together with the Privacy Policy) constitute the entire agreement between you and EKHO concerning the Service.

Severability. If any provision is held invalid, the remaining provisions remain in effect.

No waiver. Failure to enforce any right or provision is not a waiver.

Assignment. You may not assign these Terms; EKHO may assign them freely.

19) Changes to these Terms

We may update these Terms. If changes are material, we will take reasonable steps to notify you (e.g., in-app). Continued use after changes constitutes acceptance.
